Terms of Service – UByDesign Digital Wardrobe App

Welcome to UByDesign (the “App”, “Application”, or “Service”), provided by MindFusion (“we”, “us”, or “our”).

Please read these Terms of Service (“Terms”) carefully before using the App. By downloading, accessing, or using UByDesign, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

Description of Service
UByDesign is a digital wardrobe organization and styling application that allows users to:

Photograph, catalog, and categorize personal clothing items and accessories.
Create and schedule outfits and receive automated daily outfit suggestions (“Daily Recommendation”).
Browse and optionally share clothing items and outfit inspirations to a public Community Gallery.
Access external shopping links to browse or purchase third-party products.
Back up and restore personal wardrobe data to personal cloud storage (e.g., Google Drive, iCloud).

Privacy & Personal Data
Your privacy is important to us. Most of your wardrobe data and photos remain stored locally on your device or in your personal cloud storage. Please review our Privacy Policy
(https://ubydesign.net/privacy-policy) to understand how we collect, use, and protect information when you use our App, our Gallery, and third-party services such as Google AdMob.

User-Generated Content & Community Gallery
The App includes an optional Community Gallery where users may upload and share photos, descriptions, and styling layouts of clothing items or outfits (“User Content”).

A. Your Responsibilities

You retain ownership of any photos and descriptions you upload.
You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit the User Content you share.
Prohibited Content: You agree NOT to upload, share, or submit any content that:
- Infringes on any copyright, trademark, patent, or proprietary rights of others.
- Contains nudity, sexually explicit material, violence, hate speech, or harassment.
- Depicts or reveals personal identifiable information of any other person without their express consent.
- Violates any applicable local, national, or international law.

B. License Grant to the Public Gallery
By sharing items or outfits to the Community Gallery, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to host, display, reproduce, and distribute that specific content within the App and Gallery for other users to view, like, and download into their wardrobes.

C. Content Moderation & Takedowns
We do not guarantee the pre-screening of all gallery content. However, we reserve the right (but have no obligation) to review, moderate, refuse, or remove any User Content at our sole discretion, without prior notice, if we believe it violates these Terms or Google Play policies. If you believe any content infringes your copyright or violates community standards, please contact us at iva@ubydesign.net.

Subscriptions and In-App Purchases
UByDesign offers optional auto-renewing subscriptions and in-app features (such as ad removal and premium tools):

Billing: Payments are processed securely through Google Play or Apple App Store. Payment will be charged to your Google Play/Apple App Store account upon confirmation of purchase.
Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle. Your account will be charged for renewal within 24 hours prior to the end of the
current period.
Management & Cancellations: You can manage, change, or cancel your subscription at any time through your platform account settings:
- On Android: Open the Google Play Store, tap your profile icon, and go to Payments & subscriptions > Subscriptions
- On iOS: Open your device Settings, tap your Apple ID name at the top, and select Subscriptions* (or in the App Store under Account > Subscriptions).

Refunds: All refund requests are subject to Google Play’s or Apple App Store’s official refund policies and must be initiated through Google Play Support.

Third-Party Links & Shopping Services (“BUY” Button)
The App and Community Gallery may display links to third-party e-commerce websites and retailers (e.g., via the “BUY” button):

These links are provided solely for your convenience. We do not own, control, endorse, or assume responsibility for the content, privacy policies, pricing, inventory, or practices of any third-party websites or services.
Any purchases you make on third-party websites are solely between you and the third-party merchant. We are not liable for any loss, dispute, or damage arising from your transactions with third-party retailers.
Some shopping links may be affiliate links through which we may earn a small referral commission at no additional cost to you.

Advertisements
The free version of UByDesign is supported by third-party advertising provided by Google AdMob. These advertisements may use non-sensitive device identifiers to deliver relevant ads in accordance with
Google’s advertising policies and our Privacy Policy. Subscribing to our premium tier removes third-party banner and interstitial advertisements.

Intellectual Property
Except for User Content uploaded by users, the Application—including all software code, algorithms, styling engines, visual interfaces, graphics, icons, and trademarks—is the exclusive property of MindFusion LLC and is protected by copyright and intellectual property laws. You may not decompile, reverse engineer, copy, or redistribute any part of the App without our prior written consent.

Disclaimer of Warranties
THE APPLICATION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT CLUSTER OR CLOUD BACKUPS WILL NEVER EXPERIENCE DATA LOSS. USERS ARE ENCOURAGED TO PERIODICALLY BACK UP THEIR WARDROBE DATA.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MINDFUSION, UBYDESIGN, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, DEVICE DAMAGE, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION.

Modifications to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice by updating the “Last Updated” date at the top of this page. Your continued use of the App following the posting of any changes constitutes acceptance of those revisions.
